Autopilot Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) is incorporated by reference into and forms a part of the Customer Terms of Service (the “Agreement”) between you, the customer (“you”) and Autopilot Inc. and its affiliates (collectively, “Autopilot”, “Company”, we). This Policy sets forth certain terms and conditions upon which you may use the Products. Capitalized terms used and not otherwise defined in this Policy have the meanings ascribed to them in the Agreement.

Prohibited Content and Use

You are liable for any illegal or prohibited User Submitted Content that you upload or submit to the Account, including, for example, infringing, defamatory, or offensive materials. You may not, and hereby represent, warrant and covenant that you will not upload to the Account any User Submitted Content or otherwise use your Account or any of the Products in a manner that:

In addition, you may not, in connection with your use of the Account or any of the Products:

ANY ATTEMPT BY YOU TO DISRUPT OR INTERFERE WITH THE SERVICES INCLUDING UNDERMINING OR MANIPULATING THE LEGITIMATE OPERATION OF THE SERVICES IS A VIOLATION OF OUR POLICIES AND MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.

Monitoring

We reserve the right, but do not assume any obligation, to investigate any violation of this Policy or the Agreement. Without limiting the foregoing, we may: ​Investigate violations of the Agreement or the misuse of the Products; or

​Remove or disable access to your Account, or any other agreement we have with you for the use of any of the Products or other products and services offered by Autopilot or its affiliates

Responsibility for Your Conduct. You shall remain solely liable for the information you upload to or download from the Account. You agree to indemnify and hold harmless Autopilot and its affiliates and the Licensor from any claim, action, demand, loss, or damages (including attorneys’ fees) made or incurred by any third party arising out of or relating to your conduct, your violation of this Agreement, or your violation of any rights of a third party.

Abuse. You acknowledge that any abuse of any kind, including but not limited to threats of abuse or retribution of any Autopilot customer, Autopilot employee or any other affiliate or representative of Autopilot or the Licensor will result in the immediate termination of your Account and use of the Products.

Enforcement. Autopilot or its affiliates may investigate any reported violation of this Agreement or complaints and take any appropriate action that it deems appropriate. Such action may include, but is not limited to, issuing warnings, suspension or termination of service. In order to comply with legitimate governmental requests, subpoenas, court orders or other disclosure orders, Autopilot or its affiliates may access and disclose any information it considers necessary to comply with such requests, subpoenas or court orders, including, without limitation, user profile information (i.e. name, email address, etc.), IP addressing and traffic information, and usage history. Autopilot’s and its affiliate’s rights to disclose any such information shall govern over any terms of Autopilot’s Privacy Policy.

​Logos, Links, and Fair Use: Certain pages of the Autopilot website may contain copyrighted material or trademarks, the use of which may not have been specifically authorized by the copyright or trademark owner. For example, Autopilot uses images or screen shots of materials (which may be protected by copyright) produced by other organizations to demonstrate how to install Autopilot products and/or services. Autopilot also refers to names and products (which may be protected by trademark) owned by other organizations, for the purposes of identifying the product and how Autopilot’s software and services may integrate with that product. In most cases Autopilot does not have any affiliation with, and is not being endorsed or sponsored by, these other organizations. Autopilot believes that its use of the copyright and trademarks of others this type of context qualifies as fair use under copyright and trademark laws. ​
